as harmless as it seems i have been told by mates that work in the mines that any sorta shenanagins that make it look like you aren't taking the job seriously will get you fired. as mantorok alluded to... even taking off your hi-vis during a break is a fireable offence. that's why i don't work in the mines.. f*** that lameness.

That's not entirely true. If you predominately work in the office (admin, engineers, planning etc) you don't have to have your hi-vis on in the office obviously, only when moving around site.

One place you don't f*** around is mine sites. It's all about safety, procedures, rules and regs... Anyone that doesn't follow the rules will get the sack, so i don't feel sorry for the blokes in the op, just happy for anyone that was working with them cause anyone who doesn't follow the rules is a risk to their fellow workers...

Unless you can prove you were 'unduly forced to watch on despite your protesting' you should be given the sack.

WHS is everybody's game. I'm not surprised that these guys should have some 'hoops to jump through' (including, but not limited to, doing s*** that is retarded on a job site.)

On face value it seems like a knee-jerk reaction; however there are workplaces that would just as soon fire you on the spot for CARRYING a mobile phone (regardless of whether or not it is in an 'active call' or even if it is off.)

If the policy somewhere down the pages states 'thou shall not do stupid s*** on a work-site' then you'll find that the employee's out on their asses won't be surprised by the decision at all.

They are in an underground mine. They would get warnings every single day, if not multiple times per day. underground mines are f*****g dangerous places and the rules are there for good reason.

As for the watching it and doing nothing. I would argue that I was forced to watch it through fear of difficult to show evidence of retribution by the work colleagues. So if I said to stop, I risk being singled out of a group of people I must work very closely with daily.
These people already show their complacency of work health related matters, bullying a person for trying to stop it wouldn't be out of the question. Therefore you did the best option available to you, a quite protest by not participating in the event.

Something like that anyway, a good lawyer could make it read nicely.

This would not wash with the Courts if you knew about the event. Duty of Care prevails above all else. In other words, did you discharge your Duty of Care to your fellow workers by not saying anything to them?
